How to Tell if a Role is Really Outside IR35

Seeing "outside IR35" on a job advert is a good start, but it shouldn't be the end of your assessment.

Whether a role is genuinely outside IR35 depends on the reality of the working relationship, not just the wording in the advert or contract.

Here are some of the signs to look for.

The role is advertised as "outside IR35"

Most genuine outside IR35 opportunities make this clear in the job advert or contract documentation.

If the IR35 status isn't mentioned, ask the recruiter or client before progressing too far in the interview process.

The client has assessed the role

Medium and large organisations are generally responsible for determining the IR35 status of an engagement.

A client that has clearly assessed the role is usually a positive sign.

You're engaged to deliver an outcome

Outside IR35 contractors are typically engaged to provide specialist services or deliver a project, rather than simply filling a vacancy.

A role focused on delivering defined outcomes is generally a stronger indicator than one describing day-to-day employee responsibilities.

You have professional independence

Independent contractors are usually trusted to decide how they complete the work.

While clients will naturally define the required outcome, genuine contractor engagements often provide greater freedom over how that outcome is achieved.

The role doesn't resemble permanent employment

Be cautious if the role appears almost identical to a permanent employee position.

Potential warning signs include:

  • Being managed exactly like employees
  • Being integrated into staff rotas
  • Having the same responsibilities and expectations as permanent staff
  • No clear distinction between contractors and employees

None of these automatically mean a role is inside IR35, but they're worth understanding before accepting it.

Ask the right questions

Before accepting a role, consider asking:

  • Has the client determined this role to be outside IR35?
  • Has an IR35 assessment been carried out?
  • Is there a Status Determination Statement (where applicable)?
  • What does the project involve?
  • What outcomes am I expected to deliver?

A reputable recruiter should usually be able to answer these questions or obtain the information from the client.

Red flags

Treat these with caution:

  • The recruiter isn't sure whether the role is inside or outside IR35.
  • The advert says "outside IR35" but provides no supporting information.
  • The client appears to expect you to work exactly like a permanent employee.
  • The IR35 status changes several times during the recruitment process.

These don't necessarily mean the role isn't genuinely outside IR35, but they're worth investigating before accepting an offer.

Remember: the advert isn't the final answer

A job advert is only a summary.

The contract, the client's assessment and, most importantly, the actual working arrangements all contribute to determining whether an engagement is genuinely outside IR35.
